At the request of Col Thos M Harris I came out through Ritchie and this County to ascertain the prospects of two companies forming for the 10th - one in Harrisville and the other in this place, and also to fill his engagement to attend a meeting here on yesterday. On my arrival here I found the recruiting Officer Mr L. M. Marsh busily engaged, and doing good service with very flattering prospects of success, having recruited 44 men since the 8th of January, able bodied effective men. Mr Marsh certainly deserves much credit for his exertions and as he informs me he has been at considerable expense, it certainly would be consistent with right if in your power to give his commission a back date that will make him whole. I expect myself in a short time to make application for a commission as Major of the 10th should we be able to progress far enough before the end of the war - though from present prospects the officers of the 10th will hardly have a chance for distinction or extinction in the present war. Things in Gilmer have been quiet for some time and I believe are likely now to continue so.

I have the honor to recommend 2nd Liut. John H Bailey of Company C of our Regiment to be commissioned Captain of said Company, he being at present the only commissioned Officer in the Company. Capt Wm D Hall having been dismissed the service by sentence of Genl. Court Martial to date from August 1st 1864 and 1st Liut James P. Conley dismissed by order of the President to date from 12th Sept 1864.

I also recommend Sgt Guynn Minter of same Company as 1st Liut. They are both men whose habits and qualifications render them worthy the position and the faithful services hitherto rendered by them in the Company justifies their appointment.

I can give you nothing interesting from this portion of our army, as the army merely skirmishes a little each day with our Cavelry and we are lying in camp, eating valley mutton and beef, without any idea as to our next step. The simptoms however indicate a move shortly, as the burning of houses, barns etc. seemed to be completed last evening.

I have the honor to recommend assistant Surgeon Jonathan R Blair for promotion to Surgeon of the Regiment viz Dr George C Gans Decd and also Isaac W Bouse Steward to receive the appointment of assistant Surgeon.

The laborious duties performed by these gentlemen as well as their well tried qualifications I am sure will justify the step.

Dr. Gans died on the 4th Inst and I presume Dr Blair's commission could date to rank from that time.

Your letter enclosing commissions of Capt Bailey & Liuts Minter and Garrett was duly recd.

I have to request further that a commission issue for Nimrod Kuykendall as First Lieutenant in Company K of this Regiment, he is the oldest Sergeant in the Company and has really been the most efficient business man in the Company. The aggregate of the Company is Seventy two and has but one commissioned officer, Benjamin Moats 2nd Lt who is lying in Hospital Wounded, ever since the fight at Winchester of the 24th July. Capt Kuykendall, the son of Nimrod - was killed in last engagement with the Rebs here and Lt. Thomas Hess resigned as 1st Lt.
