I shall comply with your suggestion in regard to recruiting party at the earliest practicable moment. From the fact that I find great difficulty in getting authority to send officers to Wheeling to ____ the muster-out of men whose term of service has expired, I infer that an application at this time, to send a recruiting party, would receive no attention.

From Snicken Ferry I sent Capt. Russell in charge of men of Cos. E and F. He returned and reported that he had procured the muster-out of the men of Co E - but that Co F could not be mustered out until an officer of the Company was present. I immediately made application that all those men whose term of service had expired or was about to expire, be sent to Wheeling - together with the necessary officers from the different Companies to attend to the muster-out stating in my application that the men could not be mustered out without the presence of their officers, and calling particular attention to the condition of the men of Company F. No return from this communication has yet been received.

There are the following vacancies in this Regiment, to wit:
Company A 1st Lieutenant
Company A 2nd Lieutenant
Company B 2nd Lieutenant
Company C 2nd Lieutenant
Company D 1st Lieutenant
Company E 2nd Lieutenant
Company F 2nd Lieutenant
Company G 2nd Lieutenant
Company K 2nd Lieutenant

Of these vacancies: 1st Sergeant John McDonald, Co. A, Allen Bloomfield Co. F and James M Hodge Co. G hold commissions as 2nd Lts- but cannot be mustered because the companies are reduced below the minimum. They are worthy, responsible men - veterans, and deserve to be mustered before any else.

The statistics of this Regiment in your possession are meagre. If you will forward to me the necessary blanks, informing me in addition what is required, it will afford me pleasure to give you all the information in my power.

I have not been officially informed of the muster-out of any of the officers and men of this Regiment. This information I require. Please take the necessary steps to have this information furnished me. In the above list of vacancies I have reported Lts Sayer, Hankison, Dyke and Wartonburg as mustered-out - but have only been unofficially notified of the fact.

I hope your efforts to fill the Regiments of West Virginia may be successful.

I answered Your communication of July 22nd several days since - as soon as it was recd.

I learn that there is difficulty about the muster-out of men at Wheeling. Capt Hall, the bearer, will explain to you the difficulties we have labored under here - and that the fault- is not attributable to any one here.
