I wrote to you a few days ago requesting that Dr. Nellis be commissioned as Assist. Surgeon 10th W. Va. merely stating that there was a vacancy but without stating how it came lest you may not have been notified of the fact. I now write to inform you that this vacancy exists by the resignation of Dr I Bouse Assist Surgeon of the 10th. As we are very badly off for Medical officers I am anxious to have every vacancy that exists filled as soon as possible.

Hoping that you may find time to visit the W. Va. troops of my command very soon I am

March 17th 1865

I have been informed by the Sec. of War that I will be retained in the service and as my time as Col. of the 10th has expired by virtue of Gen. Orders I suppose my promotion will date from the 12th Inst. Lt Col. Hall goes out today. This leaves a vacancy in the 10th for a Lt. Col. You will confer a favor on me if you will commission Capt. M. A. Darnall of Co. A. of the 10th to that office. Taking everything into account he is the man who ought to have it. He was the ranking Captain is a brave faithful devoted and able officer and in my opinion the welfare and efficiency of the Regt. Cannot be better promoted than by his promotion. He has just been mustered out of the service by reason of the expiration of the term of his company and goes to his home in Upshur Co. Should it be your pleasure to commission him please send his commission to him at French Creek Upshur Co. W. Va. and send me a notice at the same time of the fact.

Permit me to ask that you commission Capt L. M. Marsh as Lieut. Col. of the new regt. about to be organized out of the detachment of the W. Va. regts. I take it for granted that Lieut. Col. Darnall will be promoted to the Colonelcy and I understand that Lieut. Dan. Curran will be made Maj. of the regt. Capt. Marsh is highly competent and every way worthy was wounded in the service and ought not to go back in his old grade. I hope it may be your pleasure to promote him. I would also recommend that Dr. Welch of the 15th be recommissioned as he is desirous of remaining in the service and I think has always given complete satisfaction.

Since writing to you today I have recd. the above from Capt. Marsh and forward it at once. Lieut Curran is a very good officer but I think Capt. Marsh has superior claims as he has been long a citizen of W. Va. and raised a company for the service which he commanded until he was wounded. Lieut Curran moreover is an Irish Catholic and I am almost afraid to trust them even after they have apparently stood the trial.

Governor,
I write to call your attention to the fact that the 10th regt will be reduced to six companies by the 17th of March proximo and to ask you to send enough of new recruits and drafted men to keep up its regimental organization if possible.

I do not know that it will be in your power to do so but should it be I think it would greatly promote the efficiency of the service to keep up as far as possible the old organizations.
