I have the Honor to report that I have been on Engineer Dudty since I was commissioned and I am now by order of Major Genl Milroy appointed on his staff I was here last summer fortifying by order of Major Genl Sigel and after leaving here I proceeded with the rest of the forces to Harpers Ferry when I was appointed on the staff of Col Miles Comdg. after the sorender of the place I proceeded to Annapolis Md- and was just from there to Camp Duglas Chicago. Remaining there two days I was ordered back to Harpur Ferry where I remained untill the 25th of December 1862 when the question arose that I was parroled, leaving there by orders I remained in Hagerstown untill duly exchanged and untill ordered here- I am now Chief Engineer on Genl Milroys staff. Since here, I have received a Communication from the Adjt Genl of the Army of Washington in which I am informed that being my commission as an officer in the service of the U. S is not recorded and consquently that I am not considered in the U. S service- Furthermore Genl Schek through his A. A. Genl has Refered the same Question here to know if I have my Commission and the first order of my detail on Engineer duty, both of there questions rcd an answer I am prepared to show the order detailing me on Engr duty but as Regards the Commission I have not been able to find it since our return from this post last September 1862. I know I was mustered in the U.S Service by the mustering officer at Wheeling Va Major R.E. Elarry Q.M. U.S.A. If I am correct you informed me that I was or was to be Captain of the Company. Now that these questions have been raised will you send me a new commission or an official letter which will enable me to lay the proper authority before the Government so that the case may be properly disposed of--continued

I have worked faithfully for the service and never flinched from any duty. Should there be any cause for this omision that my name as an officer in the sercive of the U.Sates is not on file in the Adjt Genl Office by reasons that the parties dismissed fro mthe service and Cavalry Company G 1st Va Cavalry have been reinstated in command therely excluding me. I pray you that you send me a commission as Capt of Cols Engineer. Otherwise for reasons I have not had nor have control off many difficulties may arise not only cousing me trouble buy prevent further ad vancement-- The reason of the questions submitted by the department and Genl Schenck arose from my wish to be ordered to my company whilst I lay at hagerstown waiting orders wishing to be assigned to action duty in the field- Genl Morecrance also applied to the war department upon my request- sent to him from Hagerstown at that time- that I be ordered to report to him for duty-- the reply sent to him was that I was not in the Service also then matters troubled me but as insomuch that I knew I was commissioned and mustered into the U.S.Service I gave it less heed than it deserved but after bieng ordered her by Major Genl Schenck I became convinced that something was wrong and that some neglect had caused this number question.

I have sent by mail for a copy of my muster signed by Major R. E. Clancy Hoping that your just appreciation of my promotion will induce you to befriend me I am dear sir

Last month (july) I addressed a communication to the Govr. inclosing two letters one From Major Genl R Q Milroy and Lt Col McGee in relation to my lost commission and promotion to a major in the 1st Va Cavalry-- You perhaps may be aware of my position (Engineer) as you where at Winchester Genl Rosecrans and others have recommended me but it is my own fault that I have not ben promoted ese this -- Clon application to my duties in the field has prevented me urging my claims. Will you please befriend me in my application.

I have at last concluded all my labours and been mustered into the service I am now on may way for my horses and bagage and will return immediatly to take command of my company I spoke to Genl Kelley about getting all the 1st Virginia in his commnd together. He promised to do so and is now doing it two companies parted here this morning down to the Kanawha River.
