On this the September 11th day AD 1866 before me Davidson [unreadable text] a justice of the peace in and for Said County and a State ca[?] Edath Drake Residence of the County of Roane and State of West Virginia and who being by me duly sworn states that she is the mother and only heire [sic] of Samual Drake who was a member of Captain William Kings Company of State Militia in and fore the state of West Virginia and who afterwards Enlisted in the United Stats [sic] I the said Edath Drake do hereby constitute and appointe [sic] JM McWhorter of the county of Roane residing in Wheeling in the state of West Virginia to sign my name to the rolls of said company now in the [unreadable text] off [sic] office of Wheeling West Virginia and to receive the amount due on account of the survice [sic] of my said son Samual Drake rendered in Said Company and to do and performe [sic] any all and all other lawful acts necessary to be done in and about the premises hereby rectifying and conformig [sic] all and severally the acts my said attorney may lawfully do in and about my said cause are witness where of I have hereunto set my hand and seal on the day and year first above written

Sworn to subseribed [sic] and acknowledged before me in my said County by Eday Drake to me personlley [sic] well known to be the identical person she represents her selfe [sic] to be that is to say that she is the mother of of Samual Drake the identical person who was the soldeir [sic] as is by her alledged in the forgoing affidavit and that I have now no interest in this claim
