M. B. MULLENS, a witness of lawful age, being first duly sworn, deposes and says: Questions by Mr. Belcher:

Q: What is your name?

A: M. B. Mullens.

Q: Where do you live, Mr. Mullens?

A: At Madison, Boone County, this state.

Q: I hand you what purports to be a map of Logan, Boone and Kanawha Counties, showing points in these counties, and will ask you what, if anything, you know about that map?

A: I know those points that are marked on that map.

Q: This map was taken from the Geological Survey, was it not?

A: Yes sir.

Q: I want you to point out to the jury on this map, first the town of Marmet in Kanawha county.

A: Marmet is at that point there, at the junction of Lens Creek and Kanawha River.

Q: Now, Hernshaw?

A: That point there.

Q: Where is the town of Racine?

A: Right at that point.

Q: What is this broad, white line, what does that indicate?

A: That is the county line, as I understand it.

Q: Between what counties?

A: Kanawha and Boone counties.

Q: Now, what is this red line here?

A: Red represents the railroads.

Q: Now show the jury where Peytona is?

A: Right at that point.

Q: Next, Sproul?

A: That point.

Q: All right, now where is the town of Danville?

A: At that point.

Q: Tell the jury, in what county Danville is located?

A: Boone county.

Q: Where is Madison?

A: In Boone County.

Q: And the county seat of Boone County?

A: The county seat of Boone County.

Q: Now, where if Jeffery?

A: At that point.

Q: The next town above that, marked on the map - on the railroad line of the C and O, what is that?

A: Clothier.

Q: And the next above that?

A: Sharpless.

Q: What is this town?

A: This is Blair.

Q: Please tell the jury what the line in yellow indicates?

A: The yellow line indicates the battle front, at the time this battle was going on between the two forces.

Q: Can you estimate the distance or the length of that battle line?

A: Well, I would say it was something like 25 miles.

Q: Where is Hewetts Creek on this map?

A: Right at this point here.

Q: I will ask you if Hewetts Creek crosses the Boone and Logan county line?

A: Yes sir.

Q: And this battle line also is it a mountain range?

A: Mountain range between Guyandotte and Little Coal River.

Q: I will ask you in what county Blair is situated?

A: Blair is in Logan County.

Q: Now what is the approximate distance from Marmet to Racine? Have you figure that out?

A: I haven't exactly figured that out. I have figured the distance from Marmet to Blair, by the way of Racine.

Q: Tell us what is the approximate distance from Marmet to Racine, going by the way of Sproul, and going by the way of the C and O railroad to Blair?

A: By that route, the approximate distance, I will say would be, by the way of Sproul and through Blair is, probably, 90 to 100 miles.

Q: No, on this map, how is the county line between Logan and Boone counties designated?

A: Designated by that flat line marked across the map.

Q: From Jeffery up Hewetts Creek how far is it to the county line of Logan county?

A: Well, it is approximately 5 miles.

MR. BELCHER: We shall want to use this witness in another matter, later. We merely wanted to identify the map at this time.
