Railroad Election.

State of West Virginia:

At a special session of the County Court held for the county of Webster, on the 8th day of November, 1899, at the court house thereof, pursuant to the notice hereto pregiven, setting forth the object thereof present, Joseph Clevinger, President and J. N. Johnson and George W. White, Commissioners.

The County Court of said county deeming it desirable for the districts of Holly and Fork Lick, in said county, to appropriate money by subscription to the capital stock of the Holly River & Addison Railway company, a corporation existing under the laws of the State of West Virginia, to aid in the construction of a railroad from Palmer Junction, on the West Virginia & Pittsburgh division of the Baltimore & Ohio railroad, in the county of Braxton, to the town of Addison, by way of Holly river and its tributaries, by the route deemed most practicable by said Holly River & Addison Railway Company, a portion of which railroad is already partially constructed and now being operated, which road when completed will extend partially through Holly district. Webster county, and partially through Fork Lick district. In said county, to the extent of the sum of Ten Thousand Dollars for the said district of Fork Lick, and Three Thousand Dollars for the said district of Holly.

And for the purpose of legalizing such appropriation and subscription as to each of the said districts respectively, the Court doth now direct and order that a vote be taken from the legal voters of the said district of Fork Lick, and that a vote be taken from the legal voters of the said district of Holly, respectively, to the capital stock of the said Holly River & Addison Railway Company of the sum of Ten Thousand Dollars for the said district of Fork Lick, and Three Thousand Dollars for the said district of Holly, at a special election now ordered to be held for that purpose in the said district of Fork Lick and in the said district of Holly on

Tuesday, the 10th Day of December, 1899.

And the Court doth appoint the following named commissioners of said election for the district of Fork Lick, to hold, conduct, ascertain and certify according to law the result of said election in Fork Lick district for the following places of voting in said district on said date:

Precinct No. 1 - Jonathan Bennett, Levi M. Miller and C. W. Benedum.

Precinct No. 2 - S. B. Hamrick, J. D. Hamrick, and W. H. Beall.

Precinct No. 3 - L. P. B. Rose, Wm. A. Thompson and C. N. Dyer.

And the Court doth appoint the following named commissioners of said election for the districts of Holly to hold, conduct, ascertain and certify according to law the result of said election in Holly district for the following places of voting in said district, on said date:

Precinct No. 1. A. J. Salisbury, Harmon Tracy and H. P. Cutlip.

Precinct No.2. Andrew McCourt, A. E. Lynch and James Salisbury.

Precinct No. 3. I. S. Cutlip, J. A. Howell and Thomas Cogar.

The ballots used at said special election shall have written or printed thereon the words "For Subscription," or the words "Against Subscription."

If it shall appear by the vote hereby authorized that not less than three - fifths of the voters of said Fork Lick District, who shall have voted upon the question of such proposed appropriation and subscription by said Fork Lick district, were in favor of the same, such subscription will thereafter be made to the capital stock of the Holly River & Addison Railway Company on behalf of the said district of Fork Lick; and if it shall appear by the vote hereby authorized, that not less than three-fifths of the voters of said Holly district, who shall have voted upon the question of such proposed appropriation and subscription by said Holly district, were in favor of the same, such subscription will thereafter be made to the capital stock of the Holly River & Addison Railway Company on behalf of the said district of Holly, provided said Holly River & Addison Railway Company shall deposit with the Sheriff of this county the sum of One Thousand Dollars as a fund to guarantee the construction of said railway conditioned that in the event said subscription is made, if the said road be constructed to the town of Addison within fifteen months from the date of said special election, then the said One Thousand Dollars shall be by the said Sheriff refunded to the said Holly River & Addison Railway Company: but in the event such road be not so constructed within the time aforesaid, the said sum of One Thousand Dollars shall be paid by the Sheriff of said county to the credit of the School Fund of Holly district and Fork Lick district in the proportion that the amount subscribed by said districts, respectively, shall bear to each other; and in no event shall said bonds be delivered until the said railroad is completed to said town of Addison.

Said subscription of Ten Thousand Dollars and said subscription of Three Thousand Dollars shall each be paid in the coupon bonds of said districts, respectively, each to be for the sum of Five Hundred Dollars or some multiple thereof, and to bear interest at the rate of six per centum per annum, the interest to be pad annually, and the principal to be redeemable in thirty years, or at the pleasure of this Court after five years from the date thereof, which bonds shall be received by said corporation in payment of the subscriptions aforesaid at par. Said bonds are to be issued as prescribed and directed by law.

And it is hereby made a condition upon which this vote is taken, and bonds to be issued, that the said road shall be substantially built and permanently maintained for the conveyance of passengers and freight from said mouth of Holly river to the town of Addison, in said Webster county.

This order shall be published in each of the newspapers published in the county of Webster, and otherwise throughout the said county for the period of time and in the manner prescribed by law.
